Kain Knight launches new Costs Estimates service
Following the decision of Leigh v Michelin Tyres, it is more important than ever to ensure the costs estimates you present to your clients are as accurate as possible and any firm who ignores this does so at its own risk.
In a recent article in the ALCD (Association of Law Costs Draftsmen) Journal, John Foy QC and Mark Whalan* summarised the lessons learned from Leigh as follows:
1. Costs estimates are likely to assume a greater significance and it is important to get them as accurate as possible.
2. The courts are likely to be more vigilant in ensuring that costs estimates are filed in the appropriate form.
3. In preparing an estimate it should be assumed that the case will go to trial.
4. An estimate can be revised at any time.
5. Costs judges will have Leigh in mind in future assessments and it is therefore worth looking at ongoing cases to see what estimates have been given and whether they are still valid.
An out of date or inaccurate costs estimate may well cost you money, so for your peace of mind Kain Knight can now offer its London clients an in house service to provide suitable breakdowns.
This new service can involve a draftsman preparing either a schedule or a “skeleton bill” comprising costs incurred and estimating future costs. On successful conclusion of an action we simply add a narrative and relevant schedules to produce the final bill, and with much of the work already complete the time taken to produce the bill can be significantly reduced.
Meanwhile our fees for either of the estimates can be recovered just as you would recover our fee for producing the bill itself.
