This was an application for a costs capping order in group litigation on behalf of 59 patients who claim to have been raped or sexually assaulted by a gynaecologist working for the Defendants.

A six week trial was due to commence on 12 January 2004. The parties agreed that a cost capping order was appropriate in respect of profit costs. The guideline rates for Cornwall were applied reducing the Grade A fee earner's rate from £265 to £150 per hour, and the estimate for time spent was reduced by 50%. Leading counsel was allowed a brief fee of £50,000, an hourly rate of £250 per hour being considered reasonable for leading counsel, with a refresher rate of £1,750 a day. Junior counsel's fees were allowed at one half of leading counsel's fees.
